Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") govern your use of Luniat's ("Luniat", "we", "us") platform and services provided via www.luniat.com and associated applications. By registering for or using the service, you accept these Terms.

If you represent a company or organization, you warrant that you have the authority to enter into this agreement on behalf of that organization.

2. Service description

Luniat provides an AI-powered platform that helps stores and businesses:

• Generate text content (captions, hashtags, post copy) based on uploaded images using artificial intelligence
• Adapt content for different social media platforms (Instagram, Facebook, TikTok, Google Business)
• Publish and schedule posts directly to connected social media accounts via the Zernio publishing engine
• Connect a Shopify store to automatically pull products, campaigns and statistics as content inputs
• Generate video content from still images
• Translate video content to multiple languages with lip-sync technology
• Create UGC-style video content with AI-generated avatars

3. Registration and account

To use the service, you must create an account with accurate and current information. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

You must be at least 18 years old or have the consent of a legal guardian to use the service.

4. User rights and responsibilities

You retain your rights

You retain all intellectual property rights to the content you upload (images, videos, texts). By uploading content, you grant Luniat a limited license to use this content solely to deliver the service — i.e., generate AI content and publish to your connected accounts.

AI-generated content

All AI-generated content (texts, captions, videos) created with Luniat belongs to you fully with full commercial rights. AI-generated material is automatically tagged with C2PA metadata for transparency.

Your responsibilities

You are responsible for ensuring that:

• You have the right to use the content you upload (images, videos)
• You review and approve AI-generated content before publishing
• You comply with the terms of service of each platform (Instagram, Facebook, TikTok)
• You provide accurate information during registration

5. Prohibited use

You may not use Luniat to:

• Distribute spam or unsolicited mass messages
• Publish content that infringes on others' copyright or intellectual property rights
• Spread hate speech, discrimination or harassment
• Publish misleading or fraudulent information
• Generate content that violates applicable law or social media platform policies
• Attempt to circumvent technical limitations, security measures or API restrictions
• Allow third parties to use your account without our written consent

In case of violation, we reserve the right to immediately suspend or terminate your account.

6. Payment and subscriptions

Luniat offers both free tiers (with limitations) and paid plans. Pricing and plan details are available on our website and may be updated with 30 days' notice.

• Payment is made monthly or annually in advance
• Prices are stated excluding VAT unless otherwise noted
• Subscriptions renew automatically unless cancelled before the renewal date
• Refunds are not provided for partially used periods upon cancellation

7. Termination

You may terminate your account at any time via account settings or by contacting us. Upon termination:

• The service ceases at the end of the paid period
• We delete your personal data within 90 days (see our privacy policy)
• Social media tokens are revoked
• AI-generated content already published to your social media remains published — we cannot delete posts already published

We reserve the right to terminate accounts that violate these Terms, with or without notice depending on the severity of the violation.

8. Limitation of liability

Luniat is provided "as is". We do not guarantee that:

• The service will always be available or error-free
• AI-generated content is free from errors or always appropriate
• Publishing to third-party platforms will always succeed (API limitations may apply)

To the extent permitted by applicable law, we are not liable for indirect damages, lost profits, lost data or damages caused by third-party services (Meta, TikTok, etc.).

Our total liability is limited to the amount you have paid to Luniat in the preceding 12 months.

9. Intellectual property

Luniat's platform, design, logos, AI models and technology belong to Luniat and are protected by copyright and other intellectual property rights. Nothing in these Terms grants you ownership of Luniat's technology or trademarks.

10. Dispute resolution and governing law

These Terms are governed by Swedish law. Disputes arising in connection with these Terms shall primarily be resolved through negotiation. If negotiation fails, the dispute shall be settled by the Stockholm District Court as court of first instance.

11. Changes to the terms

We may update these Terms. For material changes, we will notify you via email at least 30 days in advance. Continued use after notification constitutes acceptance. If you do not accept the amended terms, you have the right to terminate the service.

12. Force majeure

We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, strikes, internet infrastructure outages or third-party service disruptions.
